PART I
PRELIMINARY

1.    Title

These Regulations may be cited as the Liquor Licensing (Forms and Fees) Regulations.

2.    Interpretation

In these Regulations, unless the context otherwise requires “licence” has the meaning assigned to it in the Act.

LICENCING

3.    Application for licence

    (1) An application for a licence shall be made in Form I set out in the First Schedule.

    (2) A request for further particulars shall be made in Form II set out in the First Schedule.

4.    Notice of intention to apply for licence

A notice of intention to apply for a licence shall be in Form III set out in the First Schedule.

5.    Notice of intention to object

A notice of intention to object to an application for a licence shall be in Form IV set out in the First Schedule.

6.    Rejection of application for licence

A licensing committee shall, where it rejects an application for a licence, inform the applicant of the rejection in Form V set out in the First Schedule.

7.    Licence

A licence shall be in Form VI set out in the First Schedule.

8.    Variation and amendment of licence

An application for the variation or amendment of a licence shall be made in Form VII set out in the First Schedule.

9.    Surrender of licence

A licensee shall, where the licensee decides not to continue operating the business to which the licence relates, surrender the licence with Form VIII set out in the First Schedule.

10.    Transfer of licence

An application for the transfer of a licence shall be made in Form IX set out in the First Schedule.

11.    Renewal of licence

    (1) An application for the renewal of a licence shall be made in Form I set out in the First Schedule.

    (2) A licensing committee shall—

    (a)    where it rejects an application for the renewal of a licence, inform the applicant in Form V set out in the First Schedule; and

    (b)    where it approves an application for the renewal of a licence, issue the licence in Form VI set out in the First Schedule.

12.    Cancellation and suspension of licence

    (1) A licensing committee shall, before suspending or cancelling a licence, notify the holder of the intention to suspend or cancel the licence in Form X set out in the First Schedule.

    (2) A licensing committee shall, where it suspends or cancels a licence, inform the holder in Form XI set out in the First Schedule.

13.    Register of licences

A register required to be kept by a licensing committee pursuant to section 19 of the Act shall be in Form XII set out in the First Schedule.

14.    Prescribed fees

The fees set out in the Second Schedule shall be the prescribed fees for the matters set out therein.

The Liquor Licensing Restricted Licences Notice, 1961, the Liquor Licensing (Prohibition) Regulations, 1972, the Liquor (Prescribed Areas) Regulations, 1968, the Liquor Licensing (Prescribed Forms) Notice, 1959, and the Liquor Licensing (Prescribed Forms) Notice, 1964, are hereby revoked.

1.    Title

These Regulations may be cited as the Liquor Licensing (Intoxicating Liquor) (Quantities and Packaging) Regulations.

2.    Application

These Regulations do not apply to—

    (a)    the sale of intoxicating liquor on any aircraft in flight over the Republic in the course of a normal passenger service; and

    (b)    the sale or supply to, or consumption by, any person of intoxicating liquor in any licensed hotel premises.

3.    Authorised quantities and packaging of intoxicating liquor

    (1) The quantities and packaging set out in the Schedule shall be the authorised quantities and packaging for the purposes of the manufacture, import, export, keeping, stocking, bottling, packaging, conveyance, possession, sale or supply of intoxicating liquor.

    (2) A person shall not manufacture, import, export, keep, stock, bottle, package, convey, possess. Sell or supply intoxicating liquor in quantities or packaging other than the authorised quantities and packaging for intoxicating liquor set out in the Schedule.

4.    Prohibition of packaging intoxicating liquor in plastics, polythene etc.

The packaging of intoxicating liquor in plastic, polythene, sachets or similar packaging is prohibited from the date of publication of these Regulations.

5.    Prohibition of manufacture, importation, etc. of certain intoxicating liquor

The manufacture, importation, exportation, keeping, stocking, bottling, packaging, conveyance, possession, sale, supply or consumption of intoxicating liquor commonly referred to as “Tujilijili” is prohibited from the date of publication of these Regulations.

6.    General penalty

    (1) A person who contravenes these Regulations commits an offence and is liable, upon conviction—

    (a)    to a fine not exceeding two thousand five hundred penalty units or to a term of imprisonment not exceeding two years, or to both; and

    (b)    in the case of a continuing offence, to an additional fine not exceeding twenty-five penalty units in respect of each day on which the offence continues.

    (2) A court may, in addition to any penalty imposed on a person who is convicted of an offence under sub-regulation (1), order the forfeiture to the State of the intoxicating liquor which was used for the purpose of, or in relation to, the commission of the offence.

    (3) Any licence issued in respect of the manufacture, import, export, sale or supply of the intoxicating liquor prohibited under regulation 4 shall stand revoked from the date of publication of these Regulations.

1.    Title

These Regulations may be cited as the Liquor Licensing (Permitted Hours) Regulations.

2.    Interpretation

In these Regulations, unless the context otherwise requires—

“area” means the area under the jurisdiction of a local authority; and

“local authority” means a city council, municipal council or district council established under the Local Government Act.

3.    Application

These Regulations apply to the area of every local authority.

4.    Permitted hours

The permitted hours for the sale of intoxicating liquor shall be as prescribed in the First Schedule.

5.    Exempted establishments

The establishments set out in the Second Schedule are exempted from these Regulations.

6.    Revocation of S.I. No. 96 of 2011

The Liquor Licensing (Permitted Hours) Regulations, 2011 are hereby revoked.
