AN ACT
to facilitate the implementation of the Siavonga resolutions of political parties relating to constitutional and institutional reforms, separation of powers and judicial independence, tolerance, freedom of assembly and civility in politics and electoral reforms; provide for a national dialogue process to facilitate the Constitution refinement process and regulation of political parties, public order and electoral process reforms; establish the National Dialogue Forum and provide for its functions; and provide for matters connected with, or incidental to, the foregoing.

This Act may be cited as the National Dialogue (Constitution, Electoral Process, Public Order and Political Parties) Act.
In this Act, unless the context otherwise requires—
“Chairperson” means the person appointed as Chairperson of the Forum in accordance with section 5;
“committee” means a committee of the Forum appointed by the members in accordance with section 7;
“draft Bills” means the draft Constitution of Zambia (Amendment) Bill, 2019, the draft Electoral Process (Amendment) Bill, 2019, the draft Public Order Bill, 2019, and the draft Political Parties Bill, 2019, reviewed by the Forum during the review process;
“Forum” means the National Dialogue Forum established in section 4;
“legally disqualified” means having no legal capacity as provided in section 4 of the Mental Health Act;
“member” means a member of the Forum appointed under section 5;
“non-governmental organisation” means a non-governmental organisation registered, or exempted from registration, under the Non-Governmental Organisations’ Act;
“review process” means the process of reviewing and adopting the draft Bills beginning from the date of appointment of the members until the date of submission of the draft Bills to the Ministers responsible for the statutory functions to which the draft Bills relate;
“Secretary” means the Secretary to the Forum appointed under section 11;
“Siavonga resolutions” means the resolutions of Secretaries-General of political parties signed at Siavonga on 12th June, 2018;
“standing committee” means the standing committee appointed by the Forum under section 7;
“Vice-Chairperson” means a person elected as a Vice-Chairperson of the Forum in accordance with section 5; and
“Zambia Centre for Inter-Party Dialogue” means the Zambia Centre for Inter-Party Dialogue established by trust deed and registered under the Land (Perpetual Succession) Act.
3. Principles of national dialogue
(1) The following principles apply to the national dialogue process—
(a) transparency and accountability;
(b) inclusiveness and democratic decision-making; and
(c) patriotism.
(2) The Government, the Forum, political parties, non-governmental organisations and the people of Zambia shall, during the tenure of the Forum—
(a) acknowledge that the legislative authority of the Republic derives from the people;
(b) recognise the legislative power vested in Parliament by Article 62 of the Constitution;
(c) avoid discord, violence or threats of violence or other acts of provocation during the review process;
(d) undertake not to unlawfully deny, or interfere with, any person’s right to hold or attend public meetings or assemblies, the right to personal liberty, and the freedoms of expression and conscience relating to the Forum during the review process;
(e) ensure that the police protect the safety of all persons, who attend meetings or exercise the other rights in relation to the Forum from violence from whatever source;
(f) ensure that the meetings of the Forum are held in peace;
(g) respect the independence of the members; and
(h) desist from any political or administrative action that adversely affects or is likely to adversely affect the operation or success of the review process.
4. Establishment, functions and powers of National Dialogue Forum
(1) There is established the National Dialogue Forum which, subject to the Constitution, is a forum for the implementation and enhancement of the Siavonga resolutions for proposals to—
(a) alter the Constitution, based on the draft amendments proposed to the Constitution based on submissions from the stakeholders specified in the Schedule, following the enactment of the Constitution of Zambia (Amendment) Act, and additional submissions from the church; and
(b) reform the law on the electoral process, public order and regulation of political parties based on submissions from various stakeholders.
(2) The Forum may, in performing its functions under sub-section (1), vary, confirm, add or remove any provision of the draft amendments or repeals and replacements proposed to the Constitution, the Electoral Process Act, the Public Order Act and the draft provisions of the Political Parties Bill, 2019, that the Forum considers appropriate.
(3) The Forum shall, in the performance of the functions or exercise of the powers conferred by this Act—
(a) be accountable to the people of Zambia;
(b) recognise the importance of confidence building, engendering trust and developing a national consensus for the review process;
(c) ensure, through the observance of the principles referred to in section 3, that the review process—
(i) provides the members with an opportunity to actively, freely and meaningfully participate in generating and debating proposals to alter the Constitution, the Electoral Process Act and the Public Order Act and provide for the enactment of the Political Parties Bill, 2019, as contained in their submissions and appropriate technical or expert reports considered by the Forum;
(ii) is, subject to this Act, conducted in an open manner; and
(iii) is guided by the respect for the universal principles of human rights, gender equality and democracy; and
(d) ensure that the final outcome of the review process faithfully reflects the wishes of the people of Zambia.
(4) The members have, subject to the provisions of any other written law, all the powers necessary for the performance of their functions under this Act and, for that purpose, may require the attendance of any person whom the members wish to call before them or before a committee and call for the production of any document or information that may be considered relevant to the functions of the Forum.
(1) The Forum consists of all Members of Parliament and the following members appointed by the Secretary to the Cabinet—
(a) two representatives from each political party with representation in Parliament;
(b) one representative each from a political party which is a member of the forum of political parties which are members of the Zambia Centre for Inter-Party Dialogue;
(c) two representatives each of the—
(i) Zambia Conference of Catholic Bishops;
(ii) Council of Churches in Zambia;
(iii) Evangelical Fellowship of Zambia;
(iv) Islamic Council of Zambia;
(v) Independent Churches Association of Zambia;
(vi) Seventh Day Adventist Church Association;
(vii) Apostolic Church in Zambia;
(viii) Islamic Supreme Council of Zambia; and
(ix) Lusaka Hindu Association;
(d) one representative each of the—
(i) Office of the President; and
(ii) Office of Clerk of the National Assembly;
(e) two representatives of the Judiciary;
(f) one representative each of the Ministries responsible for—
(i) defence;
(ii) home affairs;
(iii) higher education;
(iv) commerce, trade and industry;
(v) local government;
(vi) community development and social services; and
(vii) chiefs and traditional affairs;
(g) ten citizens who made submissions, appointed by the Minister;
(h) one chief each from the Provincial Council of Chiefs; representing the House of Chiefs;
(i) two representatives each of the—
(i) Anti-Corruption Commission;
(ii) Auditor-General’s Office;
(iii) Bank of Zambia;
(iv) Drug Enforcement Commission;
(v) Electoral Commission of Zambia;
(vi) Human Rights Commission;
(vii) Local Government Association of Zambia;
(viii) National Pension Scheme Authority;
(ix) National Prosecution Authority;
(x) Office of the Public Protector;
(xi) Zambia Police Service; and
(xii) Zambia Law Development Commission; and
(j) two representatives each of the—
(i) Action Aid;
(ii) Bankers Association of Zambia;
(iii) Caritas Zambia;
(iv) Civil Society for Poverty Reduction;
(v) Common Grounds Network;
(vi) Economics Association of Zambia;
(vii) Foundation for Democratic Process;
(viii) Law Association of Zambia;
(ix) Manufacturers’ Association of Zambia;
(x) Media Institute of Southern Africa Zambia Chapter;
(xi) National Arts Council of Zambia;
(xii) National Women’s Lobby Group;
(xiii) Non-Governmental Organisations Coordinating Council;
(xiv) Press Association of Zambia;

(xvi) Southern African Centre for Constructive Resolution of Disputes;
(xvii) Transparency International Zambia;
(xviii) University of Lusaka;

(xxiv) Young Women Christian Association;

(xxxiii) Zambian Open University.
(2) The representatives referred to in sub-section (1) shall be nominated by their respective institutions, except that where an institution is required to nominate—
(a) two representatives, one of the nominees shall be a woman; or
(b) three or more representatives, at least two of the nominees shall be women.
(3) An Institution may, in writing, nominate an alternate member to take the place of the member in the absence of that member in the Forum.
(4) A person shall not be appointed as a member of the Forum if that person—
(a) is not a citizen of Zambia;
(b) is an undischarged bankrupt;
(c) is legally disqualified;
(d) has been convicted of an offence involving fraud or dishonesty; or
(e) has been convicted of an offence under this Act or any written law and sentenced to imprisonment for a term of six months or more without the option of a fine.
(5) The President shall, subject to ratification by the Forum at the first meeting of the Forum appoint a Chairperson of the Forum.
(6) Where the Forum refuses or delays the ratification under sub-section (5), the President shall appoint another person to that office and shall submit the appointment for ratification by the Forum.
(7) Where the Forum refuses or delays the ratification under sub-section (6), the President shall appoint another person and that appointment shall take effect.
(8) The members shall elect two Vice-Chairpersons of the Forum from among themselves.
(9) If the Chairperson is a female, one of the Vice-Chairpersons shall be a male and if the Chairperson is male, one of the Vice-Chairpersons shall be a female.
(10) The Minister shall, within two days of the appointment of the members, convene the first meeting of the Forum at which the members shall ratify the Chairperson and elect Vice-Chairpersons.
6. Tenure of office and vacancy
(1) Subject to the other provisions of this Act, the term of office of a member is from the date of appointment and shall, unless the member resigns in accordance with sub-section (2) or the office falls vacant earlier in accordance with sub-section (3) or (4), terminate 10 days from the date of the first sitting, on which date the Forum shall stand dissolved.
(2) A member, except a member of the National Assembly, may at any time after appointment, resign, by notice in writing to the Secretary to the Cabinet, through the Chairperson and the resignation shall take effect immediately.
(3) The office of a member becomes vacant if the member—
(a) dies;
(b) resigns from office;
(c) is removed from office in accordance with sub-section (4);
(d) is adjudged bankrupt;
(e) is absent from three consecutive meetings of the Forum of which the member has had notice, without the prior approval of the Chairperson;
(f) is legally disqualified;
(g) is for any other reason unable or unwilling to act as a member, except that this paragraph does not apply to a Member of Parliament;
(h) ceases to be a representative of the institution which nominated that member;
(i) is convicted of an offence under this Act or any other written law and sentenced to imprisonment for a term of six months or more without the option of a fine; or
(j) in the case of a member of Parliament, ceases to be a member of Parliament.
(4) The Secretary to the Cabinet may, on the recommendation of the standing committee, remove any member from office if the member, contrary to the principles specified in section 3—
(a) during the deliberations—
(i) behaves in a manner which causes discord; or
(ii) is violent, threatens any person with violence or does anything that is provocative;
(b) unlawfully interferes with any other person’s right to hold or attend a public meeting or assembly or the person’s personal liberty or the freedoms of expression or conscience in relation to the Forum; or
(c) takes any political, administrative or other action that adversely affects the deliberations or the operation or success of the review process.
(5) Where a member resigns from office in accordance with sub-section (2) or the office of a member becomes vacant in accordance with sub-section (3) or (4), the Secretary to the Cabinet shall appoint another member in that member’s stead in accordance with section 5(1).
(1) There shall be a standing committee of the Forum consisting of one of the Vice-Chairpersons and eight members of the Forum, one of whom shall be a legal practitioner, elected by the members during the first meeting of the Forum convened under section 5(6).
(2) The standing committee shall consider and determine disciplinary matters relating to the members.
(3) There shall preside at a meeting of the standing committee—
(a) the Vice-Chairperson; and
(b) in the absence of the Vice-Chairperson, a member of the standing committee that the members present may elect from among themselves for the purpose of that meeting.
(4) The Forum may, for the purposes of performing its functions under this Act, constitute a committee and delegate to that committee any of its functions as the Forum considers appropriate.
(1) Subject to the other provisions of this Act, the Forum may regulate its own procedure.
(2) The Forum shall hold a number of meetings or sittings in a manner that the members shall consider necessary for the performance of their duties under this Act, except that the Forum shall not hold any meetings or sittings at any time during which the National Assembly is sitting.
(3) The quorum at any meeting or sitting of the Forum and of any of its committees shall be one half of the members.
(4) There shall preside at any meeting or sitting of the Forum—
(a) the Chairperson;
(b) in the absence of the Chairperson, a Vice-Chairperson; and
(c) in the absence of the Chairperson and a Vice-Chairperson, a member that the members present may elect from among themselves for the purpose of that meeting.
(5) The members shall elect one of their number to be the spokesperson for the Forum during the first meeting of the Forum convened under section 5(6).
(6) Questions before the Forum or any of its committees shall be determined by consensus, but in the absence of consensus, decisions of the Forum shall be determined by a simple majority vote of the members present, except that voting shall be by secret ballot.
(7) The Forum may invite any person whose presence is in its opinion desirable to attend and to participate in the deliberations of a meeting or sitting of the Forum but that person shall have no vote.
(8) The validity of any proceedings, act or decision of the Forum shall not be affected by any vacancy in the membership of the Forum or by any defect in the appointment of any member.
(9) The Forum shall cause minutes to be kept of the proceedings of every meeting or sitting of the Forum and every meeting of a committee established by the Forum.
9. Attendance of meeting or sittings by members of public
(1) A member of the public may attend the meetings or sittings of the Forum on giving at least two days’ notice and being accredited and, for that purpose, the Chairperson shall ensure the orderly conduct of members of the public in attendance, except that nothing in this section shall preclude the members from holding deliberations in private or in camera if the circumstances so warrant.
(2) A member of the public attending a meeting or sitting of the Forum shall not disrupt the proceedings of the Forum or become violent or threaten any person with violence or do anything that is provocative.
(3) A person who contravenes sub-section (1) commits an offence and is liable, on conviction, to a fine not exceeding fifty thousand penalty units or to imprisonment for a term not exceeding six months, or to both.
10. Publication of deliberations
(1) The Forum shall publicise its deliberations or avail a record of the proceedings of any meeting through the print and electronic media or the Gazette.
(2) The Forum shall, for the purposes of sub-section (1), consult the Zambia National Broadcasting Corporation and other broadcasting stations and radio stations licensed under the Independent Broadcasting Authority Act, or the Information and Communication Technologies Act, as the case may be, in order to secure suitable arrangements for the—
(a) allocation of air time and space for purposes of disseminating the deliberations of the Forum through the electronic media; and
(b) provision of a sign language inset or subtitles in all television programmes aired for purposes of paragraph (a), civic education programmes and in all other programmes covering the review process.
(3) Where a broadcasting or radio station is consulted by the Forum under sub-section (2), that station shall make suitable arrangements to broadcast programmes whose broadcast is specified by the Forum.
(1) The Secretary to the Cabinet shall appoint a Secretary to the Forum as head of the Secretariat for the purposes of the Forum.
(2) The Ministry responsible for justice is the Secretariat for the purposes of the Forum.
12. Prohibition of publication of or disclosure of information to unauthorised persons
(1) A person shall not, without the consent in writing given by or on behalf of the Forum, publish or disclose to any unauthorised person, otherwise than in the course of duties of that person, the contents of any document, communication or information whatsoever, which relates to or which has come to the knowledge of that person in the course of that person’s duties under this Act.
(2) A person who contravenes the provisions of sub-section (1), commits an offence and is liable, on conviction, to a fine not exceeding two hundred thousand penalty units or to imprisonment for a term not exceeding two years, or to both.
(3) If any person, having any information which to the knowledge of that person has been published or disclosed in contravention of sub-section (1), unlawfully publishes or communicates the information to any other person, the person commits an offence and is liable, on conviction, to a fine not exceeding two hundred thousand penalty units or to imprisonment for a term not exceeding two years, or to both.
13. Immunity of members, Secretary and staff of Secretariat
An action or other proceeding shall not lie or be instituted against a member of the Forum, a member of a committee, the Secretary or a member of staff of the Secretariat for or in respect of any act or thing done or omitted to be done in good faith in the exercise or performance of any of the powers, functions or duties conferred under this Act.
14. Duration of process and submission of draft Bills
(1) The Forum shall complete its work within a period of 10 days from the date of the first sitting of the members under this Act or a longer period that the Minister may specify by statutory instrument.
(2) Where, after the commencement of their work under this Act, the members consider the period specified under sub-section (1) to be inadequate, the members may request the Minister for an extension of the period.
(3) The Minister may, on a request under sub-section (2), extend, by statutory instrument, the period specified under sub-section (1) by a period that the Minister may consider appropriate.
(4) Where an extension of time is granted to the Forum under this section, the members shall expeditiously conclude their work in accordance with the provisions of this Act.
(5) The Forum shall, at the conclusion of the review, prepare and adopt draft Bills.
(6) The Chairperson shall submit the adopted draft Bills to the Ministers responsible for the statutory functions to which the draft Bills relate.
(7) The Ministers referred to in sub-section (6) shall, within 30 days of the receipt of the draft Bills—
(a) in the case of the draft Constitution, cause the Bill to be published in the Gazette in accordance with Article 79 of the Constitution; and
(b) introduce the published Bills in the National Assembly for possible enactment by Parliament.
15. Members’ expenses relating to Forum
The institutions which the members or members of a committee of the Forum represent are responsible for the payment of all allowances, other emoluments and any other costs of their representatives in the Forum, where the institution determines that allowances, other emoluments or any other costs are payable in relation to their representatives.
16. Funds for expenses of Forum
(1) The expenses incurred for, and incidental to, the purposes of the Forum shall be paid out of moneys appropriated by Parliament for the purpose of constitutional reforms.
(2) Without prejudice to sub-section (1), there may be made to the Forum grants, gifts, donations or bequests towards the achievement of the purposes of the deliberations and the adoption process specified in this Act, except that a grant, gift or donation shall not be made on any condition that the Forum performs any function or performs any duty or obligation other than the functions and duties under this Act.
17. Offences relating to work of Forum
(1) A person commits an offence who, when required to attend before the Forum or before a committee or to produce any document or supply any information that is required by the members—
(a) absents oneself from a meeting or sitting of the Forum or any committee without reasonable excuse and the permission of the Chairperson;
(b) refuses or fails, without sufficient cause, to produce any document or supply any information in the person’s possession or under the person’s control and mentioned or referred to in the notice served on the person; or
(c) knowingly gives false information to the members or to the members of a committee.
(2) A person convicted of an offence under sub-section (1) is liable to a fine not exceeding fifty thousand penalty units or to imprisonment for a term not exceeding six months, or to both.
18. Prohibition of external interference with member, Secretary or staff of Secretariat
(1) A person commits an offence if that person—
(a) obstructs, interferes with, or hinders the appointment, swearing-in, membership or duties of a member; or
(b) threatens violence against the Chairperson, a Vice-Chairperson, a member, the Secretary or a member of staff of the Secretariat.
(2) A person convicted of an offence under sub-section (1) is liable to imprisonment for a term not less than one year but not exceeding three years without the option of a fine.
(1) The Forum shall stand dissolved on submission of the draft Bills in accordance with section 14.
(2) Despite the other provisions of this Act, the President may dissolve the Forum if—
(a) at any stage of the review process, the members conduct themselves or the meeting in a manner that they fail to perform their functions under this Act; or
(b) the members fail to agree on the provisions of the draft Bills.
This Act shall stand repealed when the Forum presents the draft Bills to the Ministers, except that the Secretariat shall continue to operate after the repeal for the purposes of winding up the administrative affairs of the Forum.
